Operation Warriors Persist is a small group of former military members interested in helping Canadian Armed Forces service members and veterans find justice for crimes that did not result in charges when reported and investigated through the Military Justice System (MJS).
We focus on providing knowledge and resources related to private prosecution within Canada, starting with Ontario, hoping to make justice for military members more accessible and achievable.
We are not lawyers and we do not provide legal advice. We are a grassroots organization, working part time, trying to close the knowledge gap as it relates to private prosecutions within Canada.
A persistent warrior is a person who fights for what is right, and never stops, even when success seems impossible. Warriors have the righteous spirit to fight when they see injustice. Warriors persist for themselves, yes, but mostly for others, their peers and those who will come after them. Warriors value moral justice, not necessarily legal justice. Warriors persist while others may no longer have the strength; warriors will do everything in their power, use every ounce of their being, to make things right, until they have nothing left.
This website and its supporters are conducting an 'Operation" with a mission to support those true warriors who have chosen to persist in their journeys for justice. We wish to spread knowledge of the Private Prosecution process to all those military members and veterans who may need to use it and don't know about it. We hope to see many more criminal cases be accepted by provincial Crown Attorneys through this process. We want everyone to know about this alternate path to justice for military members and veterans!
We first realized that the process of Private Prosecution was even available to military members and veterans when the woman accusing Oleksii Silin of sexually assaulting her submitted her own application for private prosecution after Military Prosecutors would not lay charges. Her application was reviewed by a Justice of the Peace (JP) in the jurisdiction where the crime occurred, and that JP reviewed her evidence and decided to "issue process". This means the JP decided charges will be laid. Crown Attorneys then took the case over as if it had come to them from the police, just like any other case. She was successful! The case has since gone to trial, evidence has been presented, and the verdict was due on March 6th 2025, but has been postponed to April 23rd, 2025, and has not been postponed again to June 4th, 2025.
We, and surely all military victim/survivors alike, are eternally grateful to the fierce warrior of a woman who never gave up, and blazed the trail of private prosecutions for others. Ms. Elle Jaszberenyi is a true warrior who persisted even when the odds were against her.

We are also following a SECOND case that has been submitted through the private prosecution process in Ontario. This case concerns a gang rape by two (2) perpetrators who (allegedly) raped a young woman in 2002 at CFB Borden.
The applications for private prosecution were submitted to a Justice of the Peace (JP) in Barrie Ontario on 24 June 2024. The Pre-Enquête Hearing was held on 24 January 2025 where the Justice issued process, which means they issued a summons for each of the accused to appear in court to answer to the charge of Sexual Assault.
As of 16 April 2025, both accused have now been served and processed for the charge of Sexual Assault (s. 271) and both have attended court through legal representation.

We believe this process is a great alternate path to justice for military members and veterans whose criminal complaints have been investigated by Military Police, resulted in no charges, and cases closed with no further action planned. It is possible that the military prosecutors had to prioritize other things (like protecting the reputation of the institution) above justice for victims in certain cases. If there was an investigation, and some evidence (even if only the victim's statement), these should be submitted as part of a Private Prosecution Application in the jurisdiction where the crime occurred to get a second opinion on whether charges should be laid.
We are especially thinking of all the sexual assault complaints that were reported but never resulted in charges.
